Allgemeine Geschäftsbedingungen
1 Geltungsbereich
1.1 Diese allgemeinen Geschäftsbedingungen gelten für den Verkauf von mobilen Mehrwertdiensten wie z.B. Videoclips und allen Arten von digitalen mobilen Gütern an Verbraucher (nachfolgend „Endkunde“) durch die Datenschwester GmbH (nachfolgend „DS“), sowie der kostenfreien Weiterleitung von Endkunden an verlinkte Webseiten.

2 Leistungen der Datenschwester (DS)
2.1 DS bietet Endkunden entgeltlich mobile Mehrwertdienste wie Videoclips und weitere digitale mobile Güter (nachfolgend „Inhalte“) zur Nutzung auf mobilen Endgeräten an. DS bietet im Abonnement an. Bei Abonnements fallen die jeweils angegebenen Abonnement-Entgelte während der Vertragslaufzeit wiederkehrend und regelmäßig für bestimmte Zeiträume an („Abrechnungsperiode“).

2.2 Die jeweils gültigen Entgelte (Endpreise einschließlich Mehrwertsteuer) sowie gegebenenfalls die genauen Bedingungen des Abonnements werden
von DS im Zusammenhang mit der Bewerbung oder dem Angebot der jeweiligen Leistung verbindlich angegeben.
2.3 Abonnement-Entgelte sind jeweils zu Beginn der Abrechnungsperiode fällig. Die Bezahlung durch den Endkunden erfolgt in Abhängigkeit der gewählten Bestellmethode.
2.4 DS weist den Endkunde darauf hin, dass bei der Nutzung von WAP oder GPRS zum Abruf von Inhalten zusätzliche Verbindungskosten entstehen, deren konkrete Höhe sich nach den Bestimmungen des Vertrages des Endkunden mit seinem Mobilfunknetzbetreiber richtet.
3 Vertragsschluss; Vertragslaufzeit
3.1 Der Endkunde gibt mit der Anforderung einer Leistung von DS ein verbindliches Angebot zum Vertragsschluss ab. DS nimmt dieses Angebot an entweder durch durch die Freischaltung des Zugangs zur Leistung für den Endkunden.
3.2 Beim Einzelabruf von Leistungen besteht das Vertragsverhältnis bis zur vollständigen Erbringung der vertragsgegenständlichen Leistungen.
3.3 Der Vertrag über Abonnements läuft grundsätzlich auf unbestimmte Zeit. Er kann vom Endkunden und von DS täglich mit sofortiger Wirkung gekündigt werden. Eine Erstattung bereits geleisteter Zahlungen für einen angefangenen Abonnement-Zeitraum erfolgt nicht. Der Endkunde kann jedoch ein eventuelles Guthaben über die Kündigung hinaus bis zum Ende der bereits angefangenen Abrechnungsperiode nutzen.
3.4 Eine Kündigung des Abos kann per Anruf sowie online auf der entsprechenden mobilen Seite erfolgen. Der Endkunde ruft hierzu von seinem Mobiltelefon aus die von DS angegebene gebührenfreie Rufnummer 0800 an. Diese wird dem Endkunden auf seiner Mobilfunkabrechnung kommuniziert. Ferner kann der Endkunde seine Abos online auf der Webseite https://www.bill-info.com/mobile kündigen.
4 Pflichten des Endkunden
4.1 Die Leistungen von DS dürfen nur privat genutzt werden. Eine Weiterübertragung von Inhalten, die der Endkunde von DS erhalten hat, auf ein anderes mobiles Endgerät oder eine Vervielfältigung dieser Inhalte – auch zu privaten Zwecken – ist unzulässig.
4.2 Der Endkunde verpflichtet sich, die von DS im Rahmen des Vertragsschlusses abgefragten Daten wahrheitsgemäß anzugeben und bei Änderungen unaufgefordert zu aktualisieren.
4.3 Der Endkunde verpflichtet sich, die Dienste nicht missbräuchlich oder unter Verstoß gegen rechtliche Bestimmungen zu nutzen.
5 Gewährleistung; Haftung
5.1 DS ist um eine schnellstmögliche Freischaltung der vom Endkunden angeforderten Inhalte bemüht. DS ist beim Versand der Inhalte an den Endkunde jedoch auf die Leistungen Dritter, insbesondere der Mobilfunknetzbetreiber angewiesen. DS kann daher keine Gewährleistung für eine verzögerungsfreie Übermittlung (Bandbreite der Verbindung) der angeforderten Inhalte oder eine ständige und unterbrechungsfreie Verfügbarkeit der Leistungen von DS übernehmen.
5.2 Eine Nutzung der Dienste von DS setzt voraus, dass der Endkunde ein den technischen Anforderungen der gewünschten Leistung entsprechendes mobiles Endgerät besitzt. Die Inhalte sind nur auf mobilen Endgeräten bestimmter Hersteller oder bestimmter Typen nutzbar.
5.3 Bei Vorsatz oder grober Fahrlässigkeit sowie bei Fehlen einer zugesicherten Eigenschaft haftet DS für alle darauf zurückzuführenden Schäden unbeschränkt. Bei leichter Fahrlässigkeit haftet DS nur bei einer wesentlichen Pflichtverletzung, bei Sach- und Vermögensschäden bis zu einer Höhe, mit deren Eintritt bei Vertragsabschluss vernünftigerweise zu rechnen war. Die Haftung nach dem Produkthaftungsgesetz bleibt unberührt.

6 Datenschutz
6.1 Der Endkunde erklärt sich damit einverstanden, dass sämtliche von ihm an DS zur Verfügung gestellten Daten gemäß dem Bundesdatenschutzgesetz (BDSG), dem Telekommunikationsgesetz (TKG) und dem Teledienstedatenschutzgesetz (TDDSG) erhoben, gespeichert, weiterverarbeitet und genutzt werden, soweit dies für die Durchführung des Vertragsverhältnisses notwendig ist.
6.2 Der Endkunde erklärt sich mit der Übermittlung von Daten an verbundene Unternehmen der DS im Sinne des § 15 AktG einverstanden, soweit die Zweckbestimmung der Daten gewahrt bleibt; dies gilt insbesondere bei konzerninternen Dienstleistungen zur Vertragserfüllung.
6.3 Eine über den vorstehend beschriebenen Umfang hinausgehende Erhebung oder Verarbeitung von personenbezogenen Daten des Endkunden erfolgt nur mit vorheriger Einwilligung des Endkunden.
7 Änderung der Nutzungs- und Abonnement-Bedingungen
7.1 DS behält sich vor, diese Nutzungsbedingungen jederzeit zu ändern. Es gelten immer die zum Zeitpunkt der Nutzung des Dienstes durch den Kunden aktuellen Nutzungsbedingungen.
7.2 DS ist berechtigt, Abonnement-Bedingungen jederzeit mit Wirkung für die Zukunft zu ändern oder Abonnements inhaltlich zu verändern oder einzustellen. DS wird den Endkunden hierüber informieren.
8 Anwendbares Recht; Gerichtsstand
8.1 Die vertraglichen Beziehungen der Parteien unterliegen dem Recht der Bundesrepublik Deutschland, unter Ausschluss des UN-Kaufrechts.
8.2 Ist der Kunde Kaufmann, so ist ausschließlicher Gerichtsstand für alle Streitigkeiten aus dem Vertragsverhältnis Köln. Dies gilt ebenso, falls der Kunde keinen allgemeinen Gerichtsstand in der Bundesrepublik Deutschland hat oder seinen gewöhnlichen Aufenthaltsort nach Vertragsschluss ins Ausland verlegt hat. DS ist jedoch berechtigt, den Kunden an jedem anderen gesetzlichen Gerichtsstand zu verklagen.
Widerrufsrecht:
Sie können Ihre Vertragserklärung innerhalb von 14 Tagen ohne Angabe von Gründen , ab dem Tag – im Falle eines Dienstleistungsvertrags oder eines Vertrages über die Lieferung von Digitalen Inhalten , die nicht auf einem körperlichen Datenträger geleifert werden – des Vertragsabschlusses widerrufen. Der Widerruf muss in Textform (z. B. Brief, E-Mail) oder – wenn Ihnen die Sache vor Fristablauf überlassen wird – auch durch Rücksendung der Sache widerrufen. Die Frist beginnt nach Erhalt dieser Belehrung in Textform, jedoch nicht vor Eingang der Ware beim Empfänger (bei der wiederkehrenden Lieferung gleichartiger Waren nicht vor Eingang der ersten Teillieferung) und auch nicht vor Erfüllung unserer Informationspflichten gemäß Art 246 § 2 in Verbindung mit § 1 Abs. 1 und 2 EGBGB sowie unserer Pflichten gemäß § 312g Abs. 1 Satz 1 BGB in Verbindung mit Art 246 § 3 EGBGB. Zur Wahrung der Widerrufsfrist genügt die rechtzeitige Absendung des Widerrufs oder der Sache.

Widerrufsfolgen:
Im Falle eines wirksamen Widerrufs sind die beiderseits empfangenen Leistungen zurückzugewähren und ggf. gezogene Nutzungen (z. B. Zinsen) herauszugeben.
Können Sie uns die empfangene Leistung sowie Nutzungen (z. B. Gebrauchsvorteile) nicht oder teilweise nicht oder nur in verschlechtertem Zustand zurückgewähren beziehungsweise herausgeben, müssen Sie uns insoweit Wertersatz leisten. Für die Verschlechterung der Sache müssen Sie Wertersatz nur leisten, soweit die Verschlechterung auf einen Umgang mit der Sache zurückzuführen ist, der über die Prüfung der Eigenschaften und der Funktionsweise hinausgeht. Unter „Prüfung der Eigenschaften und der Funktionsweise“ versteht man das Testen und Ausprobieren der jeweiligen Ware, wie es etwa im Ladengeschäft möglich und üblich ist. Paketversandfähige Sachen sind auf unsere Gefahr zurückzusenden. Nicht paketversandfähige Sachen werden bei Ihnen abgeholt.
Sie haben die regelmäßigen Kosten der Rücksendung zu tragen, wenn die gelieferte Ware der bestellten entspricht und wenn der Preis der zurückzusendenden Sache einen Betrag von 40 Euro nicht übersteigt oder wenn Sie bei einem höheren Preis der Sache zum Zeitpunkt des Widerrufs noch nicht die Gegenleistung oder eine vertraglich vereinbarte Teilzahlung erbracht haben. Anderenfalls ist die Rücksendung für Sie kostenfrei. Verpflichtungen zur Erstattung von Zahlungen müssen innerhalb von 30 Tagen erfüllt werden. Die Frist beginnt für Sie mit Absendung Ihrer Widerrufserklärung oder der Sache, für uns mit deren Empfang.
Haben Sie verlangt , das die Dienstleistung oder Lieferung von Digitalen Inhalten während der Widerrufsfrist beginnen soll , so haben Sie uns einen angemessenen Betrag zu zahlen , der dem Anteil der bis zu dem Zeitpunkt, zu dem Sie uns von der Ausübung des Widerrufsrechts hinsichtlich diesen Vertrags unterrichten , bereits erbrachten Dienstleistungen im Vergleich zu Gesamtumfang der im Vertrag vorgesehenen Dienstleistung /digitalen Inhalte entspricht.
